1. Acceptance of Terms

By accessing or using the GoThereFirst™ mobile application ("App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the App.

2. Description of Service

GoThereFirst™ is a professional networking platform that facilitates connections between business professionals for career development, networking meetings, and professional relationship building. The App allows users to schedule and organize in-person professional networking interactions.

3. User Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User Account and Registration

4.1 Account Creation

You must create an account to use certain features of the App. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Conduct and Responsibilities

5.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

Use the App for any unlawful purpose or in violation of any local, state, national, or international law
Harass, abuse, threaten, or intimidate other users
Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
Transmit any content that is defamatory, obscene, pornographic, abusive, or offensive
Attempt to gain unauthorized access to the App or its related systems or networks
Use the App to solicit business in violation of applicable laws
Engage in any conduct that restricts or inhibits anyone's use of the App

5.2 Professional Conduct

As a professional networking platform, users are expected to maintain professional standards of conduct in all interactions through the App.

6. In-Person Meetings and User Safety

6.1 Platform Role and Limitations

IMPORTANT: GoThereFirst™ is a platform that facilitates introductions and connections between professionals. We DO NOT organize, supervise, or control any in-person meetings. We are NOT responsible for the conduct of users during in-person meetings.

6.2 Meeting at Your Own Risk

YOU ACKNOWLEDGE AND AGREE THAT:

Any in-person meetings arranged through the App are conducted entirely at your own risk
GoThereFirst™ makes no representations or warranties about the safety of meeting other users in person
You are solely responsible for your own safety and security during any in-person meetings
GoThereFirst™ is not responsible for any injuries, damages, losses, or harm (whether physical, emotional, or financial) that may result from in-person meetings

6.3 Safety Guidelines

Users who choose to meet in person should:

Meet in public places
Inform a friend or family member of meeting plans
Trust your instincts and leave if you feel uncomfortable
Verify the identity of the person you are meeting
Not share sensitive personal information until you are comfortable

6.4 User Verification Limitations

While we may implement verification features, GoThereFirst™ does not conduct background checks on users and does not verify the accuracy of user-provided information. Users should exercise caution and use their own judgment.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by GoThereFirst™ and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Trademarks

"GoThereFirst" and "Go There First" are trademarks of GoThereFirst™. You may not use these marks without our prior written permission.

7.3 User Content

You retain ownership of any content you submit through the App. By submitting content, you grant GoThereFirst™ a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and providing the App.

8. Prohibited Activities

You may not:

Systematically retrieve data or content from the App to create a competing service
Use any automated system to access the App
Attempt to bypass any security measures
Remove any copyright or proprietary notices from the App
Use the App for commercial solicitation unless expressly permitted

9. Third-Party Services and Links

The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party websites or services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

The App will be uninterrupted, secure, or error-free
The results obtained from using the App will be accurate or reliable
Any defects in the App will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOTHEREFIRST™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, use, or goodwill
Personal injury or property damage
Any damages arising from in-person meetings arranged through the App
Any damages resulting from unauthorized access to your account
Any damages resulting from your reliance on information obtained through the App

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS LESS.

12. Indemnification

You agree to defend, indemnify, and hold harmless GoThereFirst™, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your conduct in connection with in-person meetings arranged through the App

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

14. Dispute Resolution and Arbitration

14.1 Binding Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

14.2 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and GoThereFirst™ individually. YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.

14.3 Governing Law

These Terms shall be governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
